Former SAA chairperson Dudu Myeni has claimed her right to remain silent to avoid incriminating herself while testifying in front of the Zondo Commission of Inquiry into State Capture.

Dudu claimed that she feels that there is an axe over her head and fears that the Hawks will arrest her while she testified in front of the commission, providing evidence that could prove crucial in other cases being investigated by the Zondo Commission.

”She has an axe hanging over her head,” her senior counsel Thabani Masuku said, according to IOL.

”She’s not saying she’s not answering questions. (Evidence leader Kate) Hofmeyr can ask questions, but she has the right to invoke her right to remain silent.”

Masuku also pleaded with the court to treat his client fairly, adding that Myeni was not speaking freely because of this court order. He added that he was not suggesting that she has a blanket right to remain silent, but that she should not be placed in a position of unfairness.

Suggesting that there could be members of the Hawks outside of the court waiting to arrest Myeni, advocate Nqabayethu Buthelezi, who is assisting Masuku said that the arrest of Angelo Agrizzi legitimises concerns over Myeni’s potential arrest and self-incrimination.

Deputy Chief Justice Raymond Zondo, however, assured Myeni and her legal team that all witnesses will be treated fairly.
